Las Vegas Balan: five years after exploiting a woman incapable of consent
A woman wandered Cork city barefoot, incoherent and separated from her friends. Romanian national Las Vegas Balan led her into a laneway and sexually assaulted her. One jury failed to reach a verdict; facing a retrial, he pleaded guilty and received five years.
A woman in need of help
The woman had become separated from her friends after drinking and taking prescribed medication. CCTV showed her moving unsteadily through Cork city without shoes, entering and leaving food outlets without ordering and appearing disoriented.
Balan encountered her while sleeping rough in the city. He led her into a laneway, pushed her against a wall, groped her and tried to knock her to the ground. He then pulled her behind a van. A nearby resident heard the woman screaming and saw her partially undressed before Gardaí arrived.
The woman was found sitting on the ground, incoherent and unable to give a clear account. She later told Gardaí that she had blacked out, remembered none of the assault and had never consented to sexual activity with Balan.
The consent claim rejected by objective evidence
After his arrest, Balan accepted that the woman was very drunk but maintained that the sexual activity had been consensual. His defence told the court that he did not initially accept that intoxication could leave a person incapable of consenting.
Mr Justice Michael White rejected that position after viewing the CCTV. He found that the woman was “absolutely incapable” of consent, that Balan had taken advantage of her and that she required care and assistance, not exploitation.
The judge also recorded that the offending was not accompanied by gratuitous violence. That finding does not diminish the conviction: the offence was sexual assault of a person whose visible condition left her unable to consent.
A failed trial, then a guilty plea
The prosecution had already taken the case through a Central Criminal Court trial, but the jury could not agree on a verdict. Balan then pleaded guilty on 14 November 2019 before a retrial was due to begin.
The judge treated the plea as having some value, while noting that it came only after the first full trial. Balan had no previous convictions. On 20 January 2020, the court imposed a five-year prison term and backdated it to May 2018, when he entered custody.
The final adjudicated offence was sexual assault. This file does not call it rape. The official legislation identifies the offence and its penalty framework; the five-year figure reported here is the sentence imposed in this case.
Nationality and status limits
The principal Irish court report identifies Balan as a Romanian national who was sleeping rough and living by begging in Cork. It does not establish when or how he entered Ireland, the immigration permission he held, whether he made an asylum claim, or whether any deportation or removal process followed.
Romania is an EU member state, but nationality alone does not prove the precise residence rights or administrative history of an individual. No immigration-status or removal claim is made here without a published record.

The Irish Prison Service’s 2024 average of €99,072 for an available, staffed prison space produces a nominal five-year capacity benchmark of €495,360.
This is not an invoice, an audited marginal cost or proof that five complete years were served. The sentence was backdated to May 2018; remission, the actual release date and the historic annual cost of custody are not established in the public case report. Applying a later annual benchmark to the full nominal term is a transparent comparison only.
That figure excludes the Garda response and investigation, the first trial, preparation for a retrial, prosecution, courts, legal aid, interpretation, victim services and any immigration administration. No defensible case-specific total for those services was located.
