Latvian national Janis Esmits was arrested at the scene after passing Garda officers interrupted the rape of a woman behind Dublin’s Civic Offices. A jury convicted him of rape, acquitted him of threatening to kill, and the Central Criminal Court imposed seven years without suspending any part.
The offence and arrest
On 10 November 2007, Esmits left a Dublin nightclub with the victim. The court heard that he tried to kiss her, dragged her into a laneway behind the Civic Offices at Wood Quay, made her undress and raped her. Passing Garda officers shone torches into the laneway. The woman broke away and reported the attack; Esmits was arrested there.
Verdict and sentence
Esmits denied rape and claimed the encounter was consensual. The jury convicted him of rape but acquitted him of threatening to kill. On 12 April 2010, the court imposed seven years, refused to suspend any portion and ordered his placement on the Sex Offenders Register. Sentencing reporting described him as previously of good character.
